The Privacy Policy informs the subject about the processing of personal data by Alfa Container

Privacy Notice pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the information of data subjects (the "GDPR")

I. Basic provisions

  • The data controller is ALFA Container s.r.o. , ID No: 17203279, TAX ID No.: CZ17203279 , having its registered office at Plzákova 1138/8, Kbely, 197 00 Prague (the "Controller" or "we").
  • The Controller's contact details are sandra.riskova@alfacontainer.cz. The Controller has not appointed a data protection officer.
  • The processing is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to also as the "GDPR", and is described in more detail in these terms and conditions.

II. Sources and categories of personal data processed

  • We receive personal data directly from you when you send us an inquiry, request or order for our services. To a limited extent, we may also receive personal data from our marketing partners if you consent to them transferring your personal data to us.
  • Furthermore, we receive your personal data directly from you in the case of donations to a public fundraiser organised through a transparent bank account.
  • We process the following categories of personal data:
    • Identification data, which primarily means name, surname, date of birth and residential address.
    • Contact details such as email address or telephone number
    • Information about your interest in our products and about your orders, delivery method, place of delivery or assembly, payment including your bank account details, handling of any complaints, etc.
    • Information about the use of our website; we collect and process this information primarily through the use of cookies.
    • Records of telephone calls relating to our services or specific orders.
    • Bank account number.
  • a long-term relationship that greatly supports our mutual business cooperation.

III. Purposes and legal basis for the processing of personal data

  • We process personal data for the following purposes:
    • Processing of the order and execution of the contract between you and the Controller. The legal basis for the necessary processing of personal data is the performance of a contract within the meaning of Art. 6(1)(b) of the GDPR. For this purpose, we process identification and contact data, data about your order, including records of your telephone calls
    • Protection of our legitimate interests, e.g. to be able to prove that we have processed your order correctly and on time. The legal basis for this processing is the legitimate interest pursuant to Art. 6(1)(f) of the GDPR. For this purpose, we process identification data, data about your order and records of telephone calls.
    • Some processing of personal data is imposed on us by other legal regulations, such as accounting regulations. For the processing necessary to fulfil our legal obligations, we rely on the legal basis pursuant to Art. 6(1)(c) of the GDPR. For this purpose, we process identification data and data about your order. In some cases, e.g. in the area of subsidy applications, it is also necessary to process your birth number.
    • Offering our products and services. We send business offers to our clients, e.g. about new products in our range. The legal basis for this processing is our legitimate interest pursuant to Art. 6(1)(f) of the GDPR in conjunction with Section 7(3) of Act No. 480/2004 Coll., on certain information society services. This means that we do not need your prior consent for this processing either. However, if you do not wish us to process your personal data for this purpose, please let us know and we will stop this processing. For the purpose of offering products and services, we process identification and contact data, data about your order and data about the use of our website.
    • Sending our offers, information about our products and other commercial communications, e.g. in the form of a newsletter. If you give us your consent, for example by subscribing to our newsletter, we may send you offers of our products and services even if you are not our client. The legal basis is therefore consent within the meaning of Art. 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services. For this purpose, we process your identification and contact data.
    • Use of personal data for online marketing, displaying offers on the Internet, including on the websites of other entities. Subject to your consent, we will also use your personal data to display commercial offers in third party environments. For this purpose, we will use either data obtained from cookies or your identification data subject to your consent. These third parties to whom your data will be provided for marketing purposes will be joint data controllers with us. You can exercise all rights relating to the processing carried out by us directly with us.
    • Internal measurement and evaluation of our processes, marketing campaigns, response times to enquiries and other activities that are important for communicating with our clients and other interested parties. The related processing of personal data, which is limited to the minimum extent necessary, is necessary to protect our legitimate interests.
    • Making a donation to a public collection. We process donors' personal identification data on the basis of the performance of a contract within the meaning of Art. 6 (1) (b) of the GDPR for the purpose of exercising the rights and obligations under the donation contract, on the basis of the legal obligation under Art. 6(1)(c) of the GDPR for the purposes of complying with accounting, tax and other regulations applicable to public collections and on the basis of our legitimate interest pursuant to Art. 6(1)(f) of the GDPR for the purposes of keeping records of donors of the Controller.
  • The provision of personal data is always voluntary. However, we cannot process your order or send you offers of our products or services without your personal data.

IV. Data retention period

  • The Controller processes personal data:
    • For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller, to assert claims arising from this contractual relationship and to protect its rights in the event of a dispute, for a period of 5 years from the termination of the contractual relationship.
    • For the period specified by law for archiving documents, especially accounting documents (usually 10 years).
    • For ten years from the end of the contractual relationship for direct marketing purposes.
  • Until the consent for the processing of personal data for marketing purposes for persons who were not clients of the Controller is revoked. After the retention period has expired, the Controller will irreversibly delete the personal data.

V. Recipients of personal data

  • We are assisted in the processing of your data by a number of our suppliers, data processors, who must be provided with limited access to your personal data in order to provide the service. We will agree with each such processor the necessary steps to ensure that we do not impair the protection of your personal data or interfere with your other rights.
  • In particular, the following suppliers are the processors of your personal data:
    • Companies involved in the operation of our website and other services in connection with the operation of the website (hosting services).
    • Companies providing marketing, business representation and other consulting services.
    • Providers of mailing or cloud services such as Google Workspace and marketing and marketing campaign evaluation services, in particular Google Ireland Limited (registration number 368047).
  • We may also disclose your personal data to entities involved in the delivery of goods or the execution of payments, e.g. ALFA Container s.r.o. , ID No: 17203279
  • Subject to your consent, we also share your personal data with entities that help us with online marketing offers, including displaying commercial offers in their environment. These are mainly the following companies: Meta Platforms Ireland Limited (operator of social networks Facebook and Instagram, among others), Google Ireland Limited, Seznam.cz., a.s., SendGrid, Inc. and Microsoft Ireland Operations Limited.

VI. Your rights

  • You have the following rights in relation to the processing of your personal data:
    • The right to know whether we process your personal data and the right to access this data.
    • The right to rectification, updating or restriction of the processing of your personal data.
    • Right to erasure of personal data. However, this right does not apply if further processing is necessary in particular for the performance of our legal obligations or an executed contract or to secure our legal claims.
    • The right to ask us to transfer your personal data that we process for the performance of a contract or on the basis of your consent to you or to another data controller.
    • The right to withdraw your consent to the processing of your personal data at any time, in particular by unsubscribing from the newsletter.
    • The right to object to processing on the basis of our legitimate interest. In the case of data processing for marketing purposes, we will stop this processing without further delay. In the case of further processing based on our legitimate interest, we will individually examine whether our legitimate interest actually prevails.
  • If you believe that the processing we are carrying out is in breach of the GDPR, other legislation or these Terms and Conditions, please notify us at the contacts listed in Art. I. If you are not satisfied with the handling of your complaint, you have the right to complain to the Office for Personal Data Protection (www.uoou.cz).

VII. Final provisions

  • By submitting an inquiry or question via the online form, you confirm that you are aware of these privacy terms and that you accept them in full.
  • You also acknowledge these terms and conditions by checking the consent box via the online form.
  • The Controller may change these conditions. It will publish the new version of the Privacy Policy on its website. Therefore, please check this website on a regular basis.
